Restraining Order/Harassment Order
    There are two types of harassment orders that you
    can request. The simplest way to describe them is
    this: if you are being abused physically or verbally,
    harassed, annoyed, threatened, stalked or attacked
    by someone you are involved in a relationship with -
    this is a domestic violence type of restraining
    order; and if you are being harassed, annoyed,
    threatened, stalked or attacked by someone you are
    not involved in a relationship with (like a neighbor
    or acquaintance)- this is a civil harassment type of
    restraining order.

    First you must determine what type of order you
    need. You can obtain the forms for free at the
    court's website at www.courtinfo.ca.gov , or at the
    courthouse, and fill them out yourself. You must fill
    out the forms and them submit them to the judge
    and wait for the judge to for sign your request into
    an order before you file them. Once filed, you must
    have the other side personally served and then file
    the proof of service with the court. Again, you
    cannot have the papers served by someone who is a
    party to the case.

    We can fill out your forms for you and return them
    to you for submission to the court. It is best for you
    to submit them personally as the judge may want to
    speak with you. Once signed into order, you will be
    given instructions on how to file them while at the
    courthouse. You must them have the other party
    served.

    If you choose to have us help you with your forms,
    we will fill the forms out for you based on your
    answers to our questionnaire, and meet you at the
    court house with your forms. We will walk you
    through the process - we want to help you through
    this process. Once filed, we can serve the
    documents on the other party for you and file the
    proof of service with the court. You can also asked
    the judge to have the Sheriff or Marshall serve the
    forms for you, and you can ask that the fee for this
    service be waived, The judge will determine if you
    meet this criteria.
